Venerdì 3 dicembre 2020 un nostro compagno, Emilio Scalzo, è stato estradato dall’Italia alla Francia e rinchiuso nel carcere di Aix-Luynes.
Emilio, ex pescivendolo di 67 anni, storico attivista NoTav e dall’inizio impegnato a portare solidarietà ai migranti di passaggio tra la Valsusa e il Brianconnese è accusato di violenza contro pubblico ufficiale in seguito alla manifestazione del 15 maggio 2020 tra Claviere e Monginevro, giornata pubblica organizzata in risposta allo sgombero della Casa Cantoniera, il Rifugio Autogestito per migranti di Oulx.
Quella manifestazione, parte di una tre giorni di campeggio contro le frontiere era stata quasi subito “bloccata” da decine di CRS che avevano sbarrato la strada e inseguito il corteo lungo i sentieri per impedirgli di passare, sparando lacrimogeni, “grenade” (tipo di armi in dotazione alla polizia francese) e distribuendo manganellate. Emilio era rimasto un po’ indietro data la sua protesi ad un ginocchio e il secondo in attesa di operazione ; da seduto è stato attaccato da un gendarme che prima gli ha lanciato addosso una granata, e poi ha cercato di colpirlo con una manganellata. Emilio si è difeso. Il poliziotto di quarantacinque anni più giovane, se n’è andato con un braccio dolorante. Manganello contro un legno trovato in terra.
Il 15 settembre Emilio è stato arrestato; agenti della polizia italiana in borghese l’hanno letteralmente rapito per strada, e per molte ore nessuno ha avuto sue notizie. I mandanti sapevano quanto Emilio è amato nella valle in cui vive e dunque lo hanno sequestrato nell’ombra. Il 23 settembre gli sono stati dati i domiciliari, finché il 1 ottobre i giudici della Corte d’Appello di Torino hanno concesso l’estradizione richiesta dallo stato francese. Il 1° dicembre, dopo due mesi e mezzo di arresti domiciliari, Emilio è stato arrestato di nuovo dalla Digos di Torino (polizia politica), che ha usato una quantità enorme di celerini per bloccare le strade intorno alla sua casa, scavalcando e forzando il cancello e procedere all’arresto. E’ stato portato al carcere delle Vallette di Torino, nonostante fosse già ai domiciliari da due mesi. Perché? Per la “troppa solidarietà” del movimento, in presidio permanente davanti alla casa di Emilio per stargli vicino fino all’arresto e non lasciarlo solo. In pratica avevano paura di non riuscire a consegnarlo in tempo e fare brutta figura coi gendarmi francesi.
Il 3 dicembre è stato estradato in Francia, e rinchiuso dopo una finta udienza/interrogatorio -in cui avevano già deciso di non concedergli nessuna misura alternativa- nel carcere di Aix-Luynes, vicino a Marsiglia.
I gendarmi e la Paf (police aux frontières) controllano questa frontiera portandosi dietro una scia di morte e violenza. Già 5 sono i cadaveri ritrovati su queste montagne, tutti in fuga o respinti dalla polizia di frontiera francese. Molti i feriti, i dispersi per giorni, infiniti i respinti, maltrattati, minacciati.
Decine di persone senza il buon documento ogni giorno cercano di attraversare questa frontiera scappando guerre, povertà, discriminazioni, alla ricerca di una vita migliore. Emilio, per loro, c’è sempre stato.
Chi è il violento? Chi va a caccia dei migranti giorno e notte, respingendo decine di persone al giorno, o chi si è sempre battuto per aiutare chi di passsaggio a non morire su queste montagne?
Chi è il violento, chi picchia a comando, chi butta lacrimogeni e bombe stordenti, chi manganella o chi, semplicemente, ha provato a difendersi da questa violenza?
Noi siamo al fianco di Emilio. Tutti abbiamo ben presente la violenza della polizia francese; tutti ricordiamo i feriti tra i Gilets Gialli, gli occhi e arti persi e i pestati a sangue. I morti delle banlieu e nelle manifestazioni. I CRS che sparano ad altezza uomo lacrimogeni e granade de desencerclement.
La procura di Gap sta cercando di farla pagare a Emilio per tutto ciò che è stata la lotta alla frontiera, utilizzando la retorica del “violento” per isolare e allontanare la solidarietà. Questa volta non acusano di favoreggiamento all’immigrazione clandestina, anche se Emilio in Italia è sotto processo anche per le occupazioni dei due rifugi autogestiti. Per presunta “violenza”, è più facile accusare, e condannare. Soprattutto se la parola di chiunque contro la testimonianza di un gendarme non vale niente.
Lo vogliono far passare per uno dei leader del “movimento No Border”, solo perché in qualche immagine reggeva uno striscione ed è uno dei più vecchi del corteo. Lo stanno facendo passare per un terrorista. Quando l’hanno estradato gli hanno messo un cappuccio in testa, e il blindato era scortato da un elicottero. E’ nelle carceri francesi da oltre un mese, e hanno concesso solo ieri alla moglie le visite richieste da tempo. Fino ad oggi non gli hanno riconsegnato nemmeno gli occhiali senza la quale non riesce neanche a leggere.
Anche la scelta della prigione è indicativa: Aix-Luynes è lontana, vicino a Marsiglia. Hanno così deciso di allontanarlo dalla valsusa, dalla frontiera, per allontanarlo dai suoi cari e dalla solidarietà ben forte presente in questo territorio. Come fecero ai tempi con Eleonora, Théo e Bastien, arrestati per favoreggiamento all’immigrazione clandestina nella giornata del 22 aprile 2018 e trasferiti da Gap a Marsiglia per “motivi di sicurezza” dopo la chiamata per un presidio sotto il carcere.
Non lasciamo Emilio solo.
Scriviamogli, facciamoci sentire, attiviamoci sui diversi territori per portare solidarietà. Ognuno a suo modo, tutti i modi sono benvenuti.

EMILIO EN PRISON. APPEL À LA SOLIDARITÉ
Vendredi 3 décembre 2020, un de nos camarades, Emilio Scalzo, a été extradé de l’Italie vers la France et incarcéré à la prison d’Aix-Luynes.
Emilio est un ancien poissonnier de 67 ans, militant de longue date du mouvement NoTav (né dans la Vallée de Susa en opposition à la ligne à grande vitesse Lyon-Turin), et engagé depuis le début dans la solidarité avec les migrants de passage entre la Vallée de Susa e le Briançonnais. Il est accusé de violence aggravée sur personne détentrice de l’autorité publique suite à la manifestation du 15 mai 2020 entre Claviere et Montgenèvre, une journée publique organisée en réponse à l’expulsion de la Casa Cantoniera, le Refuge autogéré pour migrants à Oulx.
Cette manifestation, qui faisait partie d’un camping de trois jours contre les frontières, a été presque immédiatement « bloquée » par des dizaines de CRS. Les gendarmes ont barré la route et poursuivi le cortège sur les chemins pour l’ empêcher de passer, en tirant des gaz lacrymogènes, des grenades et en distribuant des coups de matraque.
Emilio était resté en arrière à cause d’une prothèse au genou et de l’autre en attente d’une opération. Alors qu’il était assis, il a été attaqué par un gendarme qui lui a d’abord lancé une grenade, puis a essayé de le frapper avec une matraque. Emilio s’est défendu. Le policier, de quarante-cinq ans plus jeune, est reparti avec un bras endolori. À matraque contre morceau de bois trouvé sur le sol.
Le 15 septembre, Emilio a été arrêté. Des policiers italiens en civil l’ont littéralement kidnappé dans la rue, et pendant plusieurs heures, personne n’a eu de ses nouvelles. Les auteurs savaient à quel point Emilio est aimé dans la vallée où il vit, alors ils l’ont enlevé dans l’ombre.
Le 23 septembre il a été placé en résidence surveillée jusqu’au 1er octobre quand les juges de la Cour d’appel de Turin ont accordé l’extradition demandée par l’État français.

Le 1er décembre, après deux mois et demi d’assignation à résidence, Emilio a nouvellement été arrêté par la Digos de Turin (police politique), qui ont utilisé une énorme quantité de CRS pour bloquer les rues autour de son domicile, en grimpant et forçant le portail pour procéder à l’arrestation. Il a été emmené à la prison des Vallette à Turin, meme s’il était déjà assigné à résidence depuis deux mois.

Donc pourquoi? Pour « l’excès de solidarité » du mouvement qui était rassemblé devant la maison d’Emilio pour rester près de lui jusqu’à l’arrestation et ne pas le laisser seul. En gros ils avaient peur de ne pas pouvoir le remettre à temps et de faire mauvaise impression avec les gendarmes français.
Le 3 décembre il a été extradé vers la France et après un passage de façade devant le JDL – ils avaient déjà décidé de lui refuser de mesures alternatives – il a été enfermé à la prison d’Aix-Luynes, près de Marseille.
Les gendarmes et la Paf (police aux frontières) contrôlent cette frontière apportant avec eux une piste de mort et de violence.
Cinq corps ont déjà été retrouvés sur ces montagnes, tous ayant fui ou ayant été repoussés par la police des frontières française. Beaucoup ont été blessés, disparus pendant des jours, et d’innombrables ont été refoulés, maltraités et menacés. Des dizaines de personnes sans le bon papiers tentent chaque jour de franchir cette frontière fuyant des guerre, la pauvreté, la discrimination, à la recherche d’une vie meilleure. Emilio a toujours été là pour eux.
Qui est le violent ? Celui qui chasse les migrants jour et nuit, repoussant des dizaines de personnes chaque jour, ou celui qui s’est toujours battu pour aider ceux qui passent à ne pas mourir sur ces montagnes ?
Qui est le violent, qui frappe sur commande, qui lance des gaz lacrymogènes et des grenades assourdissantes, qui matraque ou qui, tout simplement, a essayé de se défendre contre cette violence ?
Nous sommes à coté de Emilio. Nous connaissons tous.t.es les violences policières françaises; nous nous souvenons tous.t.es des blessées parmi les Gilets jaunes, des yeux et des membres perdus et des personnes battues à sang. Les morts dans la banlieue et dans les manifestations. Les CRS qui tirent des gaz lacrymogènes à hauteur d’homme et des grenades de désencerclement.
Le parquet de Gap tente de faire payer à Emilio tout ce qui a été la lutte à la frontière, en utilisant la rhétorique du » violent » pour l’isoler et éloigner la solidarité. Cette fois, l’accusation n’est pas d’aide à l’immigration clandestine, même si Emilio est également jugé en Italie pour les occupations des deux refuges autogérés. Pour la « violence » présumée, il est plus facile d’accuser et de condamner. Surtout si la parole de quelqu’un contre le témoignage d’un gendarme ne vaut rien.
Ils veulent le faire passer pour l’un des leaders du « mouvement No Border », simplement parce que sur certaines photos il tenait une banderole et qu’il est l’un des plus anciens du cortège. Ils le font passer pour un terroriste. Lorsqu’ils l’ont extradé, ils lui ont mis une cagoule sur la tête, et la voiture blindée était escortée par un hélicoptère. Il est dans les prisons françaises depuis plus d’un mois, et ce n’est que ces jours ci que sa femme et sa fille ont été autorisées à recevoir les visites qu’elle demandait depuis longtemps. Jusqu’à aujourd’hui, ils ne lui ont même pas rendu ses lunettes, sans lesquelles il ne peut pas lire.
Le choix de la prison est également indicatif : Aix-Luynes est loin, près de Marseille. Ils ont donc décidé de l’emmener loin de la Vallée de Susa, de la frontière, de l’emmener loin de ses proches et de la forte solidarité présente sur ce territoire. Comme ils l’ont fait à l’époque avec Eleonora, Théo et Bastien, arrêtés pour aide à l’immigration clandestine dans la journée du 22 avril 2018 et transférés de Gap à Marseille pour « raisons de sécurité » après l’appel à un manifestation devant la prison.
Ne laissons pas Emilio seul.
Écrivons-lui, faisons-nous entendre, activons-nous sur les différents territoires pour porter la solidarité. Chacun.e.s à sa manière, toutes les manières sont les bienvenues.

On Friday 3 December 2020, one of our comrades, Emilio Scalzo, was extradited from Italy to France and imprisoned in Aix-Luynes prison. Emilio, a 67-year-old former fishmonger, a long-standing NoTav activist and since the beginning engaged in bringing solidarity to migrants passing through Valsusa and Brianconnese, is accused of violence against a public official following the demonstration on 15 May 2020 between Claviere and Monginevro, a public day organised in response to the eviction of the Casa Cantoniera, the self-managed Refuge for migrants in Oulx. That demonstration, part of a three-day camping trip against the borders, was almost immediately “blocked” by dozens of CRS who had blocked the road and chased the procession along the paths to prevent it from passing, firing tear gas, “grenades” (a type of weapon used by the French police) and distributing truncheons. Emilio had been left a little behind because of his prosthetic knee and his second knee awaiting an operation. While sitting down, he was attacked by a gendarme who first threw a grenade at him and then tried to hit him with a baton. Emilio defended himself. The policeman, forty-five years younger, left with a sore arm. Truncheon against a piece of wood found on the ground.
On 15 September, Emilio was arrested; plainclothes Italian police officers literally kidnapped him in the street, and for many hours no one heard from him. The perpetrators knew how much Emilio is loved in the valley where he lives, so they kidnapped him in the shadows. On 23 September, he was placed under house arrest, until on 1 October, judges at the Turin Court of Appeal granted the extradition requested by the French state. On 1 December, after two and a half months of house arrest, Emilio was arrested again by the Digos of Turin (political police), who used a huge amount of cops to block the streets around his house, climbing over and forcing the gate and making the arrest. He was taken to the Vallette prison in Turin, although he had already been under house arrest for two months. Why? Because of the “too much solidarity” of the movement, in permanent garrison in front of Emilio’s house to stay close to him until the arrest and not leave him alone. In practice, they were afraid they might not be able to hand him over in time and make a bad impression on the French gendarmes.
On 3 December, he was extradited to France and, after a mock hearing/interrogation – in which they had already decided not to grant him any alternative measures – he was locked up in Aix-Luynes prison, near Marseille.
The gendarmes and the Paf (border police) control this border, bringing with them a trail of death and violence. Already five bodies have been found on these mountains, all of them having fled or been pushed back by the French border police. Many have been injured, missing for days, and countless have been rejected, mistreated and threatened. Dozens of people without good papers try to cross this border every day, fleeing war, poverty, discrimination, in search of a better life. Emilio has always been there for them.
Who is the violent one? The one who hunts migrants day and night, turning away dozens of people a day, or the one who has always fought to help those passing through not to die on these mountains? Who is the violent one, who beats on command, who throws tear gas and stun grenades, who truncheons or who, simply, has tried to defend himself from this violence?
We stand with Emilio. We are all familiar with French police violence; we all remember the wounded among the Yellow Gilets, the lost eyes and limbs and the beaten to a pulp. The deads in the banlieu and in the demonstrations. The riot police firing tear gas and granade at eye level.
The Gap public prosecutor’s office is trying to make Emilio pay for everything that was the fight at the border, using the rhetoric of the ‘violent’ to isolate and drive away solidarity. This time they are not accusing him of aiding and abetting illegal immigration, even though Emilio is also on trial in Italy for the occupations of the two self-managed shelters. For alleged ‘violence’, it is easier to accuse, and condemn. Especially if anyone’s word against the testimony of a gendarme is worth nothing.
They want to pass him off as one of the leaders of the “No Border movement”, just because in some pictures he was holding a banner and he is one of the oldest in the procession. They are passing him off as a terrorist. When they extradited him they put a hood over his head, and the armoured car was escorted by a helicopter. He has been in French prisons for more than a month, and only today did they allow his wife the visits she had long requested. Until today they have not even given him back his glasses, without which he cannot even read.
The choice of prison is also indicative: Aix-Luynes is far away, near Marseilles. So they decided to take him away from the Valsusa, from the border, to take him away from his loved ones and from the strong solidarity present in this territory. As they did at the time with Eleonora, Théo and Bastien, arrested for aiding and abetting illegal immigration on the day of 22 April 2018 and transferred from Gap to Marseille for “security reasons” after the call for a garrison under the prison.
Let’s not leave Emilio alone.
